Partner Paul Storm Speaks With IP Watchdog on Decline of Patent Contingency Litigation
Gardere patent attorney and intellectual property partner Paul V. Storm discussed the decline in patent contingency litigation with IP Watchdog and noted the trend is due to the quality, rather than the quantity, of patents granted by the United States Patent and Trademark Office.
“The net effect is that all patents are less valuable and weaker patents are much less likely to be asserted,” Storm said. “The overall reduction of contingency law firms and attorneys has led to a reduction of all cases and to earlier, lower settlements.”
