Feigel Comments on Circumstances Surrounding Restaurant Employee’s Suspension

Special Counsel Leonard Feigel was quoted in an HR Bartender article, “Can I Get Fired For an Accident – Ask #HR Bartender,” about whether a restaurant worker accused of breaking a glass on purpose should quit before he or she can be fired.
Feigel said whether an employee’s misconduct is intentional or accidental typically makes a difference in such cases. But just because the employee claims it was an accident may not save his or her job if the employee violated the employer’s policy or made an egregious error in judgment.
