Lisa Glahn Discusses What Makes a Solid Construction Contract
Foley & Lardner LLP Partner Lisa Glahn is quoted in the Massachusetts Super Lawyers article, “Constructing a Well-Built Contract,” discussing what construction attorneys should look out for in a construction contract.
Glahn said that as a construction litigator, she grew tired of fighting all time, and realized that “if the contract had just been written slightly differently, litigation could have been avoided.”
She explained the critical areas every construction contract should address, including the use of contingency funds, lien waiver requirements and the right to discharge liens, termination of the agreement, force majeure, and indemnification and insurance requirements.
Glahn noted that while contracts can be complex, the risk of not reading your contract can be huge. “Litigation is going to cost a ton of money. So is the suspension of works. It’s tedious. It’s painful,” she added.
