Leah Imbrogno Offers Guidance for Manufacturers As Costs Rise
Foley & Lardner LLP Senior Counsel Leah Imbrogno is quoted in the Asia Business Law Journal article, “Surviving the Deluge,” discussing the implications of the global economic slowdown and the adjustments manufacturers and suppliers might need to consider.
As costs continue to rise, Imbrogno suggests that clients review their current agreements to see if there is “any relief in their pricing provisions,” like terms relating to fixed pricing on the buy side or ways to shift increased costs to consumers on the sell side.
For companies entering into new agreements, she explained that they should consider index-tied pricing provisions that include “provisions requiring the parties to revisit or renegotiate prices at set points” to help minimize inflationary exposure in the future.
