Foley & Lardner LLP Partner Don Schroeder is quoted in the Law360 article, “Independent Unions Grew in 2022 and Aren’t Slowing Down,” discussing the success of independent union organizing this year.
While institutional support for union organizing can be helpful, Schroeder said the self-determinative nature of the independent approach can appeal to workers who are skeptical of an institution. It can also neutralize the argument that organizing would drive a “third party” between workers and management, which employers often make in labor negotiations.
“You [as an employer] have to pivot on your message, and it’s a delicate balance you’re dealing with people working there that are also leaders of the union movement,” Schroeder added.
