Foley & Lardner LLP Partner Kyle Faget and Senior Counsel Evan Hellman authored the article, “Pharmaceutical and Medical Device Manufacturer and Telehealth Provider Partnerships: Compliance Issues for Consideration” for the November-December issue of the Journal of Health Care Compliance.
Faget and Hellman discuss four considerations pharmaceutical and medical device manufacturers should keep in mind when considering telehealth partnerships: anti-kickback and beneficiary inducement risk, corporate practice of medicine and maintaining independent medical decision making, improper data sharing, and general operational compliance considerations. The authors offer guidance as to how these entities should consider structuring these types of arrangements to mitigate such risks.
