Attorney Daniel Werly was quoted in a USA Today article, “Deflategate Judge Will Put NFL’s Arbitration Process Into Focus,” on August 6, 2015. The article discussed the whether a recent example of arbitration in the National Football League regarding Tom Brady’s suspension was fair. Werly referenced similar cases where NFL members argued they did not have notice they were subject to certain policies and said, “If the judge decides those decisions for notice do apply here, then Brady has a strong position because that sort of ‘detrimental to the league’ language didn’t work in those other cases. I think that’s where the decision is going to have to be made.”
