The HHS Office of the National Coordinator for Health Information Technology (ONC) Information Blocking Rules implemented under the 21st Century Cures Act become effective on April 5, 2021, and will impact health care providers, health information networks and exchanges, and electronic health record vendors. You’ve heard of these Rules, but are you ready to comply with them?

Join Foley attorneys Chanley Howell, Jennifer Hennessy, and Kathryn Parsons-Reponte for a robust discussion on the requirements for complying with the Information Blocking Rules, including a real–world perspective and tips from UW Health corporate counsel Kerry Moskol regarding the issues health care providers are experiencing in preparing to implement the Rules. The presenters will also discuss the Centers for Medicare & Medicaid Services (CMS) Interoperability and Patient Access Final Rule, which is closely tied to the ONC Information Blocking Rules.

Key compliance risks and issues that will be addressed throughout this webinar, alongside practical guidance on how to manage said risks, include:

  • The applicability of the Information Blocking and Interoperability and Patient Access Final Rules, including the types of organizations impacted and the types of information affected;
  • Key steps organizations should be taking to implement the Rules;
  • Exceptions to the general requirement under the Rules that information be accessed, exchanged, and used upon request;
  • Limitations on charges for access to information; and
  • The processes and technology requirements of the admission, discharge, and transfer (ADT) notification rule, and advice for implementing such processes and technologies.
