Foley Partner George Simon was quoted in an article that appeared in Businessweek on August 26, 2011 titled “BlackRock Seeks SEC Approval to Start ETFs Using Own Indexes.” Simon discusses BlackRock Inc.’s application for clearance that will allow its iShares exchange-traded funds (ETFs) to follow proprietary indexes rather than those developed by third parties. He states that offering funds based on proprietary indexes could help BlackRock set itself apart from rivals, adding that it is important for companies in the ETF industry to offer exclusive licenses that other companies cannot.
