CBS 11 News, local station for the Dallas/Fort Worth area, spoke with Gardere Partner Peter S. Vogel, chair of the Firm's Internet, eCommerce and Technology Industry Team, about gossip websites and what can be done, if anything, to rid them of cruel comments.
"The standard for cyber smear is, if there's a grain of truth in the statement, it may not be slanderous," Mr. Vogel explained. He also mentioned going after the person who posted the cruel comment as an alternative, but warned this is much more expensive and legally time consuming.
