Foley & Lardner LLP Partner Roger Strode is quoted in the Healthcare Dive article, “Doctors no longer bound by noncompetes under FTC’s proposed ban,” discussing the potential impact on the health care sector of a rule put forward by the Federal Trade Commission (FTC) that would prohibit companies from requiring workers to sign noncompete clauses.
Strode explained that abolishing noncompetes may not be enforceable in nonprofit organizations, which are widespread in the health care sector. “The FTC may not have the authority under the FTC Act to impose this rule on nonprofit organizations,” he said.
