Represented Argonne National Laboratory (ANL), operated by the University of Chicago; to provide patent procurement services in both the biological and physical sciences. In the physical sciences, Foley attorneys were responsible for obtaining a large portfolio of electrochemical cell (or battery) patents. Many of these are licensed by major players in the battery technology area as part of an extensive greentech development and commercialization effort at ANL. The firm also obtained numerous patents in medical technology and counter terrorism technology.
This suit involves greentech technology for controlled water usage in restroom environments. The involved product is a very high profile, high value commercial technology, and has substantial impact on water usage and on the profitability of the company. In related matters, this client was also involved in a multi count trademark and unfair competition lawsuit with Zurn and was resolved favorably for our client, Sloan. Further, Foley has secured a reissued patent which is the subject of the patent law suit and prevented Zurn from issuing a competitive patent by virtue of our filing an InterPartes reissue against the Zurn patent. We have also obtained substantial patent coverage worldwide for Sloan covering a broad range of products including the previously mentioned greentech product which has substantial implications for control of the market.
Represented a manufacturer of light-emitting diodes (LEDs) and laser diodes in two inter partes and two ex parte reexaminations of design patents on LED technologies. Foley led the proceedings where the reexaminations were filed by a competitor against the client in parallel with infringement litigation involving the same patents. Therefore the proceedings required careful coordination with the litigation team. All four reexaminations concluded favorably for the client with a finding of patentability as to all claims.
