Foley Associate Kristy J. Downing presented “Non-Obviousness after KSR” on September 18, 2007 as a continuing legal education program through the Milwaukee Bar Association.
This presentation explained the U.S. Supreme Court’s decision in KSR v. Teleflex and examined how the inferior courts are interpreting the Supreme Court’s decision since April. Treatment of the teaching-suggestion-motivation test was discussed. Decisions from the Federal Circuit, Board of Patent Appeals and Interferences and district courts was also reviewed.

Supreme Court Clarifies Scope of Federal Fraud Statutes in Connection with False DBE Reporting on Federally Funded Projects
On May 22, 2025, the U.S. Supreme Court issued a significant decision in Kousisis v. United States, affirming a six-year prison sentence for a contractor convicted of federal wire fraud for misrepresenting use of a disadvantaged business enterprise supplier on a project.
