Since hitting the campaign trail, President Biden has promised to increase the role of Environmental Justice, or “EJ” – the idea that low-income and minority communities have faced, and continue to face, disproportionate risks from the impacts of pollution and climate change in federal policy – in enforcement and permitting efforts. From Executive Orders issued on President Biden’s first day in office to the U.S. Department of Justice‘s recently announced comprehensive EJ regulatory and enforcement strategy, the Administration has taken extensive action to incorporate EJ into federal agency decision-making, actions and budgets at a variety of levels. Although EJ is not a new concept, the current focus on incorporating EJ into decision-making and regulatory action is a marked change from efforts of previous administrations dating back more than thirty years.
