Foley Partner Christopher Cain authored an article that appeared in the November 2010 issue of Folio titled “Don’t Rush Headlong Into Software-as-a-Service.” Cain discusses the potential risks and benefits for magazine publishers who utilize a software-as-a-service (“SaaS”) solution to save time and money. He states that SaaS provides uniform features and eliminates the upfront cost of purchasing and customizing software, but notes that it also requires the publisher to forfeit control over data and potentially subject itself to federal security and privacy laws in the event of data theft.
