Foley Partner Ethan Lenz and Senior Counsel Max Chester authored an article that appeared in Risk & Insurance on November 21, 2011 titled “The FCPA and Insurance: Am I Covered or Should I Be?” The authors discuss a number of questions that a company should ask when evaluating the purchase of specific Foreign Corrupt Practices Act (FCPA) investigation cost insurance. They state that products addressing exposures to FCPA enforcement-related costs should be closely scrutinized against a company’s existing coverage and risk profile to determine if the benefits of additional coverage are warranted.
