Daniel Bachrach



Dan Bachrach is a partner and business lawyer with Foley & Lardner LLP. His practice focuses on the condominium, hotel, resort and hospitality industry, including residential, commercial and mixed-use condominiums, timeshare, private residence clubs, fractional projects and travel packages. Dan is a member of the firm’s Real Estate Practice and the Hospitality & Leisure Industry Team.

Timeshare, Condominium and Resort Experience

Dan's experience includes structuring and development of condominiums, cooperatives and vacation ownership projects, as well as preparation of legal and registration documents for such projects. He has worked with and advised many of the significant and globally recognized developers and management companies in the vacation ownership industry. Dan has also assisted clients in complying with multijurisdictional regulations.

Hotel Experience

In the hotel area, Dan has negotiated hotel management agreements, technical services agreements, license agreements, franchise agreements, and several related agreements, including celebrity chef agreements, marketing agreements and shared easements.

Consumer Finance and Privacy Experience

Dan has a broad range of experience related to consumer finance and privacy laws, including the Real Estate Settlement Procedures Act (RESPA), the Truth in Lending Act (TILA), the Gramm-Leach-Bliley Act, the Fair Credit Reporting Act, the Fair Debt collection Practices Act and the Equal Credit Opportunity Act.

Lobbying Experience

Dan is a former registered lobbyist on behalf of the American Resort Development Association (ARDA)-Florida, Florida's trade organization for the timeshare, resort and leisure industry. In addition, he has been actively involved in the drafting and negotiation of the Illinois Real Estate Timeshare Act of 1999, the Texas Timeshare Act of 2005, as well as other amendments and administrative rules and regulations affecting the timeshare industry.


Dan has been peer review rated as AV Preeminent®, the highest performance rating in the Martindale-Hubbell® Peer Review Ratings™ system.

Dan was selected for inclusion in the 2019 Florida Trend’s Legal Elite list. In 2010 and 2011, the Legal 500 recognized Dan for his real estate work. He was also selected for inclusion in the 2010 to 2013 Florida Super Lawyers® lists.

Dan has been selected by his peers for inclusion in The Best Lawyers in America© in the fields of Real Estate Law (2013 - 2022) and Leisure and Hospitality Law (2016 - 2022). Dan has been named the Best Lawyers® 2020 Leisure and Hospitality Law “Lawyer of the Year” in Orlando. This Best Lawyers® ranking is awarded to one sole lawyer per practice area and region.


Dan earned his J.D. from the University of Florida College of Law (with honors, 1996) where he was a member and senior student works editor of the University of Florida Law Review. He is a graduate of Emory University (B.A., cum laude, 1993).

Presentations and Publications

Dan is co-author of two chapters of an ABA/ARDA digest and analysis of U.S. timeshare law, as well as the co-author of a chapter entitled, “Specific Types of Condominiums,” of the Third Edition of the Florida Condominium Law and Practice, published by The Florida Bar. He is a frequent lecturer at hospitality conferences.

Admissions, Certifications and Professional Memberships

Dan is Board Certified in Condominium and Planned Land Development Law by The Florida Bar Board of Legal Specialization and Education. He has been selected by the International Society of Hospitality Consultants (ISHC) for its 2021 membership class. He has previously served as chair of the Timesharing and Interval Uses Committee of the American Bar Association's Real Property Trust and Estate Law Section. He also has served as vice president of the Orlando Museum of Art Acquisition Trust and was a trustee of the Orlando Museum of Art. He is chair of the board of trustees of Trinity Preparatory School in Winter Park. Dan is a member of the Florida and American Bar Associations.

Foley & Lardner LLP served as lead timeshare and exchange counsel on behalf of Marriott Vacations Worldwide (VAC.N) in its merger with Interval Leisure Group (ILG.O). The deal combined two of the premier global timeshare and vacation experience companies to create a more diversified company with significantly enhanced marketing potential and scale. The transaction created a leading global upper-upscale and luxury vacation ownership and exchange company, which has more than 100 vacation ownership properties around the world and approximately 650,000 owners. The combined company is the global licensee of seven upper-upscale and luxury vacation brands, including Marriott Vacation Club, Grand Residences by Marriott, Ritz-Carlton Destination Club, Sheraton Vacation Club, Westin Vacation Club, St. Regis Residence Club and Hyatt Residence Club. The combined company is a leading provider of premier exchange networks, which is comprised as nearly two million members and more than 3,200 resorts worldwide. The Foley team was led by partner Bill Guthrie, and also included partners Dan Bachrach and Matt Jassak.
Foley & Lardner LLP served as lead timeshare and exchange counsel on behalf of Hilton Grand Vacations Inc. (NYSE:HGV) in a definitive agreement to acquire Diamond Resorts International, Inc. The stock-based transaction has an equity value of approximately $1.4 billion. The deal combines the largest independent timeshare operator with HGV’s internationally recognized brand to create significant value from scale, while expanding and diversifying HGV’s resort portfolio into over 20 new markets. The combined company will have the broadest offering in the vacation ownership industry, including Diamond’s 92 leisure resorts and nearly 400,000 owners and HGV’s 62 upscale and luxury properties and over 325,000 owners. The Foley team was led by partner Bill Guthrie, and also included partners Dan Bachrach and Matt Jassak.
Represented the ownership group, Caydon USA (the US subsidiary of an Australia based developer), in negotiating the hotel and branding documents with Kimpton for a branded luxury boutique hotel that will anchor a four tower mixed-use billion dollar development and service certain residential components of the development.
