Foley & Lardner LLP Partner Carrie Hoffman is quoted in the Law360 article, “Transparency Laws Could Lift Fog Around Equal Pay Landscape,” discussing the difficulty in comparing some jobs to find unlawful pay disparities in equal pay litigation as new pay transparency laws that might provide clearer guidance begin to take hold.
Hoffman said comparing two positions is challenging because “most things are not, ‘did you make 22 widgets an hour? … It’s much more nuanced.”
“In most jobs where things are not concrete it’s much more difficult to say that this factor is somehow more elevating for one person than the other because it’s just not that obvious. All cases are not created equal, and I think it’s hard to say just because one case worked out this way that another case would work out the same,” she explained.
