Foley & Lardner LLP partner Peter Loh and associate Brantley Smith authored the Franchising Magazine USA article, “Understanding Claims of Joint Employment and Employment Misclassification.”
The authors explore two recent cases which illustrate two common legal claims (joint employment and employment misclassification) which seek to impose additional burdens and obligations on franchisors and provide context on recent increased state and federal scrutiny on franchising in general.
“Franchisors should expect continued pressure from private action plaintiffs and government agencies alike. Accusations of worker misclassification and joint employment are but two ways adversaries of franchising can apply such pressure,” the authors conclude.
