Foley & Lardner LLP partner Peter Tomasi commented on the U.S. Supreme Court’s apparent wavering enthusiasm to block federal energy and climate rules in the Law360 article, “Supreme Court Signals Skepticism On Staying Federal Rules.”
After a recent slew of refusals to block federal rules, Tomasi said, “This may appear to those justices that industry cries wolf about every rulemaking.”
“The court may stay future environmental rules,” Tomasi continued, “but only if the scope and impact are exceedingly broad, and/or the issue is one of first impression.”
