The article discussed how the Environmental Protection Agency’s final coal ash rule is likely to lead to litigation over the “surprise” provision, which governs large-scale reuse of the material. Stoll was quoted saying the reuse provision, “will inevitably be subject to many requests for clarification and guidance from potentially affected parties. It may also be especially vulnerable on judicial review, as it was never proposed.”
