Stoll Quoted on Fracking

Foley Partner Richard Stoll was quoted in an article that appeared in Financial Times on September 28, 2011 titled "Fracking: Protesters Win First Round of PR Battle." Stoll discusses guidance issued by the Environmental Protection Agency (EPA) for companies that use the fracking process to release oil and gas from underground. He states that the EPA issued a surprising rule on its website, which was that no company could use diesel in the fracking process without a permit, adding that the EPA is expected to issue more guidance that may broadly define diesel as any fluids that contain the compounds found in diesel. Mr. Stoll notes that such broad guidance could place many companies in violation of the law, resulting in law suits and attempts to clean up fracking materials that may potentially slow oil and gas production.
