Law360 reports a Texas federal judge found Allcare Health Management Systems Inc. cannot appeal an earlier decision that awarded $4.7 million in attorneys’ fees to Highmark Inc. The court ruled Allcare failed to file an appeal on time without reasonable cause.
In June, a Texas federal judge upheld an earlier award in Highmark’s long-running dispute against Allcare. The district court found that Allcare's unsuccessful prosecution of an information management system patent claim remained exceptional following a remand after Highmark’s successful appeal to the U.S. Supreme Court.
