Alexis Bortniker Comments on Greater Government Scrutiny of Major Health Care Transactions
Foley & Lardner LLP partner Alexis Bortniker is quoted in the Bloomberg Law article, “Rising Medical Costs Force Greater Scrutiny of Health M&A Deals,” offering her insight on the increased legislative and regulatory push by some states to require greater oversight of major health transactions.
Bortniker, who is co-chair of Foley’s Payor Provider Convergence area of focus, said “health care costs are the biggest impetus” for these initiatives. “Some people think we’ve had too little regulation for too long,” she explained, “and so there’s a push to continue to regulate this space that has always been pretty heavily regulated.”
Bortniker, who has experience with these kinds of regulatory changes from her time practicing in Massachusetts, explained that while businesses will “have to be a little more thoughtful,” more deliberate practices when structuring transactions “is not necessarily a bad thing.”
