Foley Partner Jon Dudas was quoted in an article titled “US patent reform revived” in the March 5, 2009 issue of Managing Intellectual Property. Dudas speaks on legislation introduced by US Senate and House Judiciary Committees that seeks fundamental changes to the US patent system, noting that the legislation adopts the House of Representatives’ approach to post-grant review by expanding inter partes reexamination rather than introducing a new post-grant review for second window challenges. He adds that the provision allows for a number of different ways for a patent to be opposed.
