Partner Richard Stoll was quoted in a Bloomberg BNA Daily Environment Report article, “Water Jurisdiction Rule Blocked in 13 States,” on September 4, 2015. The article discussed how a federal judge in North Dakota blocked a rule that would give the federal government jurisdiction over some smaller waterways. Stoll was quoted saying, “Either way [Judge Erickson] had gone on this, it would show what a crazy situation Congress has left us with by failing to clarify where judicial review should take place. So for now in a crazy hodgepodge of 13 states who happened to join in the North Dakota litigation, the new rule does not apply. On the other hand if Judge Erickson had nationalized his injunction, the rule would have been stayed even in states that support the rule and he would have been going against the grain of several other court rulings.”
