Foley Partner Andrew Rawlins was quoted in an article that appeared in BNA’s Medical Devices Law & Industry Report on June 15, 2011 titled “High Court Affirms Clear and Convincing Evidence Norm for Patent Validity Challenges.” Rawlins discusses the U.S. Supreme Court’s decision in Microsoft Corp. v. i4i Limited Partnership, which reaffirmed the patent invalidity standard established by the U.S. Court of Appeals for the Federal Circuit in 1984. He states that the decision could be viewed as a win for patent holders and a loss for possible infringers, adding that many companies will likely be glad that they can continue to rely on the deference given to the presumed validity of their patents.
