Gregory Husisan Analyzes Trump's Trade Tools Ahead of SCOTUS Tariff Case
Foley & Lardner LLP partner Gregory Husisian shared insights on the Trump administration’s reliance on alternative trade measures as the U.S. Supreme Court reviews the use of the International Emergency Economic Powers Act (IEEPA) to impose tariffs in the SupplyChainDive article, “What tools does Trump have to impose tariffs?”
Husisian, co-chair of Foley’s International Trade & National Security Practice, pointed to the administration’s leveraging of Section 232 of the Trade Expansion Act as a key example.
“One of the reasons why it’s launching so many [Section] 232 investigations is so that the backstop already is in play because Section 232 was upheld by both the Court of International Trade and the Court of Appeals for the Federal Circuit with regard to steel and aluminum tariffs in the first Trump administration,” he explained.
Husisian added that as current Section 232 investigations encompass about 40% of U.S. trade, even if the administration’s use of IEEPA is struck down, the potential impact of these probes would still be significant.
