Aaron Maguregui on Disclosing AI Use in Health Care – ‘Rules remain fragmented but are tightening quickly’
Foley & Lardner LLP partner Aaron Maguregui discussed the evolving legal landscape around artificial intelligence in health care in the Cybernews article, “Clinic calls police after woman refuses to allow AI to take notes.”
Maguregui highlighted how some states — California, Texas, and Utah — have adopted regulations that require patients be informed whenever generative AI is involved in patient communications or clinical decision support.
“Broader informed-consent and ethical principles may also compel disclosure when AI meaningfully influences care,” he explained. “The rules remain fragmented but are tightening quickly.”
Maguregui added that while patients can request limits on AI data use during care, “providers can decline if restrictions interfere with care.”
