Partner Jana Kolarik was quoted in the Hospice News article, “Stark Law Revisions Take Effect for Hospice, Other Health Care Providers,” providing insights on updates to the Stark Law that recently went into effect on January 19.
Kolarik told Hospice News, “The [Stark Law] is somewhat narrowly focused, but if hospices have financial relationships with physicians, then it is something that they need to be aware of.” She continued, “This is a low-hanging fruit for regulators because it is a strict liability statute. They don’t have to prove intent. If you fall within the criteria and don’t meet an exception, you are in violation.”
