Waltz Quoted on Settlement of CMP Case Over Provider Relief Fund Money

Partner Judy Waltz was quoted in a Report on Medicare Compliance article, “ASC Settles CMP Case About Provider Relief Fund Money; OIG: Attestation Was Wrong,” about what may be the first civil monetary penalty settlement with the HHS Office of Inspector General over Provider Relief Fund (PRF) money.
Waltz said it doesn’t take much effort for OIG or other government agencies to identify providers who received government funds after their billing privileges were revoked. Although CMS doesn’t make the list of billing revocations available to the public, it does collect the information, which is available to government auditors and investigators, she said.
“This [case] shows the government is looking for basic discrepancies in the PRF attestations and will look for more complicated ones later,” she said.
