Matthews Comments on New DOJ Guidance on False Claims Act Violations

Partner Mike Matthews was quoted in a Modern Healthcare article, “Justice Department sheds light on limiting False Claims Act damages,” about new guidance that would allow companies under investigation to minimize their liability by revealing potential False Claims Act violations early, preserving relevant documents and identifying the people who were aware of the misconduct.
Matthews, chair of the firm’s False Claims Act Litigation Group, said providers can view the guidance as a checklist, especially for potential overpayments. He also said the guidance suggests the Justice Department might be willing to lower the penalties for False Claims Act violations for companies that cooperate in investigations.
