Nelson Discusses 'Pre-Wells' Stage of SEC Investigations

Of Counsel Margaret G. Nelson was quoted in an article in the PCAOB Reporter, “Senior enforcement official: SEC will continue to pursue accountants and auditors,” about how to approach the “pre-Wells” stage of an SEC investigation, the period prior to the time the SEC notifies a person or a firm that it is planning to bring an enforcement action against them.
Nelson said she welcomes the opportunity for a pre-Wells notice meeting with SEC staff, though she acknowledged that she may be at a disadvantage because she doesn’t have access to the entire investigatory record and may not have all the information the SEC has.
