Waltz Comments on Problems with Medicare Contractors Overpayment Collection Process

Partner Judith Waltz was quoted in a Bloomberg BNA Health Care Blog article, “Are Medicare Contractors Dropping the Ball on Overpayments?” about flaws in the Centers for Medicare & Medicare Services (CMS) overpayment collection process. She said the agency can recoup an overpayment as long as the provider or supplier is still submitting claims or it can refer overpayments to the Department of Treasury for collection, but that it has limited settlement authority.
“The Department of Justice has to step in for affirmative litigation, and for settlements over a set amount, the DOJ’s approval is required,” she said.
