Foley Partner Lawrence Kraus was quoted in a Massachusetts Lawyers Weekly article on February 22, 2012 titled “CEO Sanctioned for Destroying Evidence.” Kraus stresses the importance of holding on to all documents that may be of interest in e-discovery disputes. He adds that while the absence of documents can be addressed and explained, it is certainly not the ideal scenario and may be challenging for a jury to overlook.
