Selling Goods and Services to the Federal Government with Reduced Risk Through Commercial Item Contracting

Partner George Ash and Senior Counsel Erin Toomey explained the concept of commercial item contracting with the U.S. government and its benefit to contractors, including expanded business, lower costs and the ability to contract on normal commercial terms. The authors point out that government contracting increases the potential for liability under the False Claims Act, but note that contractors may reduce violation risks by limiting the type of contact entered into with the government.
