Foley Partner Russell Beck authored an article titled “Is ‘binding mediation’ a new solution?” in the December 31, 2008 issue of the Business Law Bulletin of Virginia. In his article, Beck provides insight into the structuring of a binding mediation, an alternative to litigation and arbitration where the mediator between parties holds the right to issue a final decision if negotiations between the parties prove unsuccessful.
