Foley attorneys Janice Anderson, Heidi Sorensen, and Cheryl Wagonhurst are speaking at the Health Care Compliance Association's (HCCA) Compliance Institute, April 13 - 16, 2008 in New Orleans, Louisiana.

Ms. Anderson is speaking on April 13, 2008 from 9:00 a.m. - 12:00 p.m. with Sanford Tolchin, Vice President Clinical Excellence for Physician Affairs at Ascension Health and Susan Nedza, Vice President, Clinical Quality and Patient Safety at the American Medical Association. Their session is titled "Quality of Care: Transforming Health Care Through Payment Reform, Public Reporting, and Enforcement. Topics to be covered include:

  • The federal reimbursement system is in the midst of profound change to align quality with the right to receive payment. At the same time, the government is using the False Claims Act to crack down on hospitals that provide poor quality care
  • The health care industry is in the midst of a quality revolution and many new initiatives are being implemented by both public and private entities to drive quality of care
  • Quality is posing new compliance risks for health care organizations, and current structures may not be effective in identifying and mitigating the risks
  • New structures and approaches to monitoring quality are required to allow providers to perform better under the new reimbursement models and to avoid costly and damaging enforcement actions based on quality

Ms. Sorensen is speaking on April 14, 2008 from 1:30 p.m. - 2:30 p.m. with Robert DeConti, Office of Counsel to the Inspector General. Their session is titled "Federal and State Administrative Sanctions." Topics to be covered include:

  • Review of recent OIG civil monetary penalty law and exclusion actions
  • OIG’s enforcement priorities, including physician financial arrangements and medical device manufacturers
  • Coordination between federal and state authorities in the exercise of administrative remedies and ramifications for third party payors
  • Exploring the question of issue preclusion in an administrative proceeding based on a civil False Claims Act decision
  • Overview of administrative authorities, including Federal health care program exclusion, state Medicaid exclusions, OIG’s civil monetary penalty authority, and carrier and intermediary sanctions (pre-payment review, focused medical review, suspension of payment)

Ms. Wagonhurst is moderating a panel on April 14, 2008 from 1:30 p.m. - 5:30 p.m. Panelists for this session include Paul Belton, Vice President, Corporate Compliance at Sharp Healthcare. Michelle Cooper, Corporate Responsibility Officer at Catholic Health Initiatives, and John Steiner, Chief Compliance Officer at the University of Kentucky. Their session is titled "Large Hospital & Health Systems." This session will focus on practical issues unique to large hospitals and large health systems. Our panel members are comprised of representatives of for-profit and not-for profit hospitals and academic medical centers. This session will allow for ample audience participation and discussion and sharing of practical tools and processes.
