Over the past several years, the futures industry has experienced a rash of high-profile bankruptcies of futures commission merchants: Sentinel Management Group, MF Global, and Peregrine Financial.

While the precipitating causes of the bankruptcies may vary, each insolvency has raised difficult customer protection issues, mired customers and their segregated funds in protracted bankruptcy proceedings, and spawned wide-ranging litigation. Foley has played a central role in each of these bankruptcies and its related litigation.

In the "Rules of Engagement" seminar, the Foley team will explain the current status of these cases, newly proposed customer protection rules, and the key issues affecting every futures industry participant. We also will explain how every futures industry member can take concrete steps to protect itself from the risks associated with these insolvency scenarios. Armed with the most current lessons learned in the insolvency battles, our clients will be better prepared for the next turn of events.
