Frederick Geilfuss Discusses Hospitals and Price Transparency Compliance

09 June 2022 Modern Healthcare News

Foley & Lardner LLP Partner Frederick Geilfuss is quoted in a Modern Healthcare article, “Fines kicking in after slow start to hospital transparency rule,” discussing a recent study from the Journal of the American Medical Association finding that fewer than six percent of hospitals obeyed the federal Hospital Price Transparency Rule during the early months of its implementation.

Geilfuss noted that “larger systems have said the fines for noncompliance are pretty low and the possible impact on competitive harm could be much more significant,” mirroring the data that many health systems were more willing to pay the fine than gather and publish data. He continued, “The sensitivity to what managed care contracts say and what hospitals would potentially have to give up in negotiations is an issue that is completely unknown.”
