Titled “Arbitration and Bankruptcy: A Tug of War,” the attorneys first cover how FAA pro-arbitration policies conflict with the Bankruptcy Code, then transition into the interplay between the statutory regimes for “non-core” and “core” bankruptcy matters, and finally conclude that court standards and analyses are highly dependent on the facts of their respective cases.
