As part of the Foley-sponsored Drug Discovery and Development track, David Rosen, partner and co-chair of Foley’s Life Sciences Industry Team, led the session, “Combination Drug and Device Products – Is the Pathway Towards Success?”
As the drug, device and biologics industries continue to advance and medical products become more sophisticated and personalized, the classical distinctions between what the Food and Drug Administration (FDA) considers a “drug” or “device” begin to blend together. This session looked to inform the audience on this particular area of combination products and how companies can navigate the regulatory, business and legal process for converging technologies including:
- Successful business development case studies for drug device combination products
- Legal barriers and issues for navigating FDA approval pathways and techniques that are being implemented by companies to move their products through FDA
- Best strategies for structuring business agreements between patent holders, financiers, suppliers and distributors
- Issues that are holding companies back and which need to be addressed to allow for medical and economic advancement
