Nathaniel Lacktman, partner and chair of Foley’s Telemedicine & Digital Health Industry Team and chair-elect of the ATA Board of Directors, will be a speaker at the Out-Of-Pocket 2025 Retreat on February 28, 2025. Lacktman’s presentation is titled, “Digital Health Law: 2025: What to Expect, Legal/Regulatory Trends, and AMA.”
This fast-paced, irreverent workshop will give attendees concrete, actionable answers to their burning legal questions; offer advice on how to better communicate with and extract more value out of startups’ legal advisors; and instill confidence in how founders and operators of high-growth digital health companies assess risk on regulatory compliance vs business needs. We will cover an overview of the important legal trends in digital health for 2025 and what entrepreneurs need to know. In the first part of the session, we will discuss issues such as multistate Medicare enrollment and billing, fraud & abuse traps to avoid, sustainable contracting models vs “suspect contractual joint ventures,” DTC subscription memberships and concierge billing, mail order pharmacies and lab testing, social media advertising and influencers, and off label promotion. In the second part of the session, we will hold space for participants to share their legal brain busters and regulatory questions, fielding them lightning round style in an Ask Me Anything format. Participants will also receive valuable 50-state heat maps of telemedicine laws.
