Recognizing that public litigation can possibly attract unwanted regulatory attention, Partner Lisa Noller said that opting for an alternative dispute resolution (ADR) may keep legal conflicts out of the public awareness. Noller added that invoking an ADR clause early in legal proceedings can potentially help a business investigate facts and conduct discovery in relative privacy, without legal requirements to make the proceedings public.
