Foley Partner John Douglas was quoted in an article that appeared on Employment Law360 on July 1, 2009 titled “NLRB Erred In Nursing Home Case Ruling: DC Circ.” Douglas speaks on a federal appeals court decision that denied enforcement of a National Labor Relations Board ruling barring S&F Market Street Healthcare from implementing new terms and conditions for employment workers after the company purchased a California nursing home. Douglas, who represented S&F, said that the ruling marks a return to the letter of a previous Supreme Court decision that made it clear that a purchaser of assets of a unionized company or facility has the right to set initial terms and conditions of employment.
