Foley Partner Michael Leffel was quoted in an article that appeared in InsideCounsel on July 1, 2010 titled “CAFA Loophole Keeps Class Action in State Court.” Leffel discusses a 7th Circuit ruling that was influenced by the 1941 case of Shamrock Oil & Gas Corp. v. Sheets and creates a loophole in the Class Action Fairness Act’s (CAFA) jurisdictional powers. He states that efforts were made to help the courts properly interpret the 1941 decision, but adds that it is unlikely that Congress will address the issue.
