Foley Partner Mark Plichta was quoted in an article that appeared in Pensions & Investments on August 8, 2011 titled “Activist investors won’t let court ruling affect proxy access.” Plichta discusses a U.S. Court of Appeals ruling which overturns the SEC’s proxy access rules, stating that it is questionable whether the SEC could rewrite the rules to provide a more complimentary cost-benefit analysis that would satisfy the court’s objection.
