Gardere Partner Peter S. Vogel, chair of the Firm's Internet, eCommerce and Technology Industry Team, spoke to E-Commerce Times about the six-strike warning system expected to take effect by the end of 2012. The warning scheme is thought to be a result of discontent with tactics used by the Recording Industry Association of America and the Motion Picture Association of America.
"The RIAA filed over 35,000 lawsuits and only two went to trial," Mr. Vogel explained. "Even though those trials were high visibility and the defendants were ordered to pay very high fines, they didn't appear to dissuade people from downloading music."
