Jane Fergason, a partner in Gardere’s corporate practice group, recently spoke with Direct Selling News about Vemma Nutrition Co.’s recent settlement with the Federal Trade Commission. The agreement states that the company must comply with specific rules that ban the misrepresentation of services or potential for financial success.
“I don’t see the Vemma settlement as containing anything we haven’t already heard or highlighting anything companies shouldn’t already have been addressing,” she said. “It’s less particular and specific than Herbalife’s settlement, and it reinforces and provides clarity on the FTC’s expectations.”
