In two separate opinions, the Fifth Court of Appeals ruled that a Dallas trial court erred in exercising jurisdiction over a Mexican insurance company and a broker in a lawsuit by a candy manufacturer arising from damage to a facility in Juarez. The court of appeals rendered judgment dismissing the case against the insurance company and the broker.

As reported by Law360, “Seguros Afirme did not purposefully direct any action toward Texas or initiate any interaction in the state – Elamex [the candy company] came to it, by way of CGM [the broker]… the mere fact that Seguros Afirme knew Elamex had factories in Texas, ‘taken alone, is insufficient to confer specific jurisdiction.’”
